TERMS & CONDITIONS
We cannot wait to welcome you to Olive and Rose ‘O&R’. We will be on hand to help you with every step of your wedding dress buying journey but please also ensure you are fully aware of our Terms and Conditions set out below. Acceptance of our quotation constitutes acceptance of these terms also. Acceptance of terms is granted either by the purchase of goods or in writing with the intention of purchase of goods. We would also recommend that you have wedding insurance.
From here on:
Collection Form means the form signed by You following inspection and acceptance of the Goods.
Goods means any goods, dress or gowns agreed in the Order Form to be supplied by the Us to You.
Order Form means the order completed between Us and You which shall be deemed to incorporate these Terms and Conditions.
‘You’ refers to the customer listed on the Order Form
‘Us'/’We’/’Our'/'O&R’ refers to Olive and Rose
ORDER FORM
The Order Form shall be on these Terms and Conditions to the exclusion of all others. No terms and conditions contained in any confirmation of order, purchase order or other document provided by You or verbally, will form part of the Order Form.
PRICE AND PAYMENT
The price for the Goods shall, unless otherwise agreed, be the price identified by Us to You and set out at the time of the initial consultation and set out in the Order Form. The price for the Goods shall be displayed inclusive of VAT but exclusive of all and any costs of insurance which You shall pay in addition. The cost of alterations are not included in the price of the Goods unless otherwise stated at the time of purchase. Alterations are carried out by independent seamstresses and the purchase price shall exclude all costs in respect of alterations; You are not obliged to use the seamstresses recommended by us and we will not be held responsible for any alteration work undertaken by the seamstress recommended to You.
A deposit of 50% of the order value shall be due upon signature of the Order Form. Payment can be made by cheque, cash or credit card. Payment shall not be deemed to have occurred until We have received cleared funds. Any additional charges unknown at the time of the undertaking of work, for example shipping costs, will be charged at the time when such fees are understood. These charges will be applied at
the rate of the third-party supplier costs.
Once the initial payment of 50% of the purchase of your dress is made, the purchase is final – there are no cooling off periods, your Goods will be ordered upon receipt of this payment on the date of purchase and we will not be able to cancel any order, under any circumstances, and all remaining money owed will be payable. Items that are made to order cannot be returned for a refund or exchange. The remaining balance is payable once your dress is ready to be shipped.
ORDER CHANGES, CANCELLATIONS AND RETURNS
Once the initial payment of 50% of the purchase of the Goods is made, the purchase is final, and you will not be able to cancel, amend, return or exchange your order (including under exceptional circumstances such as pandemics, cancellation of wedding or change of heart) and the remaining balance is payable at the final fitting. We shall not be liable for any losses or costs relating to a change in the dimensions of the Customer after the order was placed or for a dress not fitting correctly due to fluctuations in weight, body size and/or changes in body shape once an order has been placed. To enable Us to perform the contractual terms You must cooperate by providing Us with your exact measurements/dimensions.
Sizes and measurement will be taken by O&R at the time of purchase. Each of the key measurements taken will derive a dress size. O&R will use the largest measurement when ordering your dress. This will be agreed by the bride and O&R at the time, but Your decision is final, and O&R will not be responsible for disagreements on sizing post this initial sizing appointment.
Dresses with beading and embroidery may differ slightly in the amount/placement of the beading/embroidery to that of the sample dresses. This is due to the dress being handmade, material is produced in rolls and a reasonable amount of difference is possible, as such O&R hold no responsibility for slight variations in fabric. Lace placement and draping can vary slightly with dress sizes vary.
Due to the delicate nature of the handmade fabric certain crepes and satins will contain variations in appearance, shade and in the weave, this is down to the manufacturing process and is out of O&Rs control.
DELIVERY
Each dress is handmade and as such we will provide an approximate shipping date based on the designers lead times, current order volumes, work schedules, fabric availability, market conditions or a particular characteristic of the order placed. These are approximate and as such You must understand this cannot be rushed. Time needs to be allowed for the process to be completed and your dress to be made to perfection. The designer reserves the right to vary this date should a delay in production incur. Alterations will not be carried out by O&R, as such we strongly advise that You build this into your required timescale when buying.
Due to circumstances out of O&Rs control there can be delays in transit. We shall do our best to keep you updated with the anticipated date of delivery of the Goods but understand that times may vary through the process. We shall not be held responsible for any delays to the completion of Goods.
Our designers reserve the right to ship a gown according to a wedding date not according to production timescales. Production schedules are
the designer’s decision.
We will endeavour to provide the highest quality goods as standard, and these will arrive in a merchantable quality. Any wear and tear or depletion of goods due to use and wear and tear are not our responsibility, and we will not be obliged to give a replacement or refund. O&R shall perform a quality check on all Goods ordered and You shall be afforded an opportunity to inspect the Goods upon collection. However, once the Goods are handed over and you have signed the Collection Form and taken/received your completed garment(s), they are your responsibility. If in future your garment requires modification, alteration or repairs (due to general wear-and-tear or damage) we would be happy to assist you at our standard hourly rate. O&R shall not be held responsible for any damage and defects identified once the Goods are taken
from the premises. This does not affect your statutory rights.
RISK & OWNERSHIP
Risk in the Goods shall normally pass to You on delivery unless you have asked Us to hold onto Goods on Your behalf in which case risk passes
to You at the point that you instruct us to hold them for you. However, ownership in the Goods shall not pass to You until We have received in full in cleared funds all sums due to Us in respect of the Goods.
WARRANTIES
We warrant that the Goods are of satisfactory quality. If You wish to make a claim under this warranty, You shall notify us promptly and specify the defect in full detail and give Us a reasonable opportunity to inspect the Goods. If O&R assess to be responsible for any defect, Our liability under the warranty shall be limited to repairing or replacing the Goods in question or refunding the price of such Goods. We can give no assurance or warranty that cloth used in manufacturing the Goods will be identical in colour, shade or texture with any sample you select.
LIMITATION OF LIABILITY
Our liability in contract, tort or otherwise arising out of the subject matter of the Order Form shall not exceed the original price of the Goods. Under no circumstances will We be liable to You for any consequential, special, indirect or economic loss.
FORCE MAJEURE
If We are subject to circumstances outside Our reasonable control, including but not limited to war, insurrection, riot, fire, industrial disputes, civil commotion, terrorism, pandemics or act of god and default of any sub-contractors, We shall notify You and such notification shall have the effect of suspending Our obligations under this Contract until We notify you that the event of Force Majeure no longer applies.
GENERAL
If any part of these Terms is found to be void or unenforceable by any Court of competent jurisdiction, such part shall be severed from these Terms which will otherwise remain in full force and effect.
These Terms shall be governed by and interpreted solely according to English Law and the parties submit to the exclusive and sole jurisdiction of the English Court.
SAMPLE SALE DRESSES
If buying a sample dress rather than a made to order gown these items are sold as seen. They must be paid for in full at the time of purchasing. Sample sale dresses are non-returnable once they have left the premises.
ACCESSORIES
All accessories must be paid for in full when placing an order. Made to order accessories are bespoke handmade designs and as such cannot be returned after purchase. We shall therefore only accept returns for accessories which are damaged or defective prior to final hand over. It is your responsibility to check the goods thoroughly prior to hand over. As these are handmade there can be slight variance in bead placement and tone of colour. Accessories sample sale stock sold have a return policy of 14 days for a refund or exchange, the item must be returned in a saleable as new condition.
